Terms and Conditions for the use of the Energy Force Ireland website and for the supply of services detailed on the website
Our Agreement
These terms and conditions are the terms and conditions upon which Energy Force Ireland (EFI) makes the EFI websites (www.efi.ie www.energyforceireland.ie or www.energyforceireland.com) available to you and any services which are accessible via the website.
Use of Website
- EFI grants you a limited licence to access and make personal use of the website, but not to download or modify it.
- The website or any portion of the website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose.
- You are granted a limited, revocable and non-exclusive right to create a hyperlink to the website as long as the link does not portray EFI or its products in a false, misleading or otherwise offensive manner or claim any association with EFI.
- You will not use any EFI logo or other proprietary graphic or trademark as part of the link, without our written consent.
- You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.
- EFI reserves the right to refuse access to the website.
Price
- The prices payable for the service that you order are as set out in our website or as otherwise agreed in advance.
- Payment will be accepted by pre-cleared cheque or cash on the day of inspection.
- All payments to be made directly to the assessor dealing with your property.
- Where a reduced price 2nd BER is to be completed the following applies.
- EFI must have completed a design stage assessment, provisional BER service or a full BER Service on the property within the previous 9 months.
- You must notify EFI in writing within 3 months of the initial service that you intend completing works on the property and will require a second assessment.
- You must obtain and produce to EFI singing off certificates for any works completed during the period between initial service and the final BER service
Delivery and Performance
- We will send one of our assessors to the address to carry out the service at a time and date previously agreed with you.
- Our services will be performed in as efficient a manner as is practical, however time is not of the essence, quality and accuracy is.
- Provisional BER's on new builds may not require a site visit.
Cancellation by You
- If you wish to reschedule an appointment we will make every effort to accommodate you, however should any order be cancelled by you, any payments made are non-refundable.
Cancellation by Us
- We reserve the right to cancel the contract between us if:
- we have insufficient personnel available to carry out your order;
- your order was listed at an incorrect price due to a typographical error.
- you fail to provide any necessary information
- you fail to provide adequate access to the property
- the nature of the property poses a risk to the health and/or safety of our personnel
- If we do cancel the contract we will notify you by email, telephone or letter as we deem
appropriate.
- Where the contract is cancelled due to conditions 15a or 15b we will either offer an alternative or refund any monies paid by you as soon as possible.
- Where the contract is cancelled due to conditions 15c, to 15e we reserve the right to charge for any actual expense incurred by EFI including, but not limited to, the cost of any site visits made. Any remaining balance will be refunded to you as soon as possible.
We will not be obliged to offer any additional compensation for disappointment suffered or for any other reason.
Liability
- Any BER certificate which you obtain as a result of the visit from our assessors is marked on a standard scale and we are in no way liable for the grade awarded to your property on the Certificate.
- Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation.
- Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law, or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
- We will do our utmost to ensure that availability of the website will be uninterrupted, however, this can not be guaranteed at all time. EFI accepts no responsibility for any such suspensions, restrictions, interruptions or delays. We reserve the right to make changes to our website, policies and these terms and conditions at any time.

A notice under or in connection with these terms and conditions shall be in writing and shall be delivered personally or sent by post or by email, as follows:

Events Beyond Our Control
We shall have no liability to you for any failure to deliver services you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.
Privacy
You acknowledge and agree to be bound by the terms of our privacy policy. Please go to the Privacy Policy Page on this website for further information.
Entire Agreement
These terms and conditions, together with the website prices, contact details and privacy policy, set out the whole of our agreement relating to the supply of the services to you by Energy Force Ireland and use of the website.
Governing Law
The contract between us shall be governed by and interpreted in accordance with Irish law and the Irish courts shall have jurisdiction to resolve any disputes between us.
